New New Bilibid Prison Detainee - Maj. Gen. Carlos Garcia

Retired Major General Carlos Garcia, Maj. Gen. Carlos Garcia was arrested and detained today, September 16, 2011 over charges of misappropriation of military funds.

The retired Maj. Gen. Carlos Garcia was first detained at the Camp Aguinaldo but was immidiately transferred to the New Bilibid Prison (NBP) earlier at around two in the afternoon. Garcia was escorted by the government forces for the whole transfer to aid to the retiree's security.

The retired Major General was arrested at around 8:30 in the morning, Friday, September 16, 2011 after being found guilty to the charges against him. He was sentenced for two years, which is the minimum, by the military court for violating the Articles of War 96 and 97.

Charge against Garcia for the Article of War 96:

"Conduct unbecoming of an officer and gentleman for failing to disclose/declare all his existing assets in 2002 and 2003 and for holding the status of an immigrant or permanent resident of the United States thereby causing dishonor to the military profession."

Charge against Garcia for the Article of War 97:

"Conduct prejudicial to good order and military discipline for making untruthful statements under oath about his true assets in his 2002 and 2003."

Retired Maj. Gen. Carlos Garcia was arrested after being found guilty for false declaration of his Statement of Assets and Liabilities and for having a US green card while serving in the Philippine military.

According to the media reports, the retired Maj. Gen. Carlos Garcia had only verbal resistance when the Intelligence Service of the Armed Forces of the Philippines arrested him, and no physical interruptions was made from Garcia's camp. The authorities said that Carlos Garcia was surprised for the said arrest. With this, it can be known that the whole procedure was kept classified until the warrant of arrest is about to be serve, since the media got the actual arrest.

Meanwhile, New Bilibid Prison or NBP officer in charge Supt. Richard Schwarzkopf told the media that they will not give any kind of VIP treatment to Carlos Garcia and he will be treated like any other inmates. The retired officer however has the right to have his visitors just like any other else's does.

Carlos Garcia will undergo medical examination and will be turned over to NBP Reception and Diagnostic Center.
